Thirteen years ago today, Papua’s “Team 100” was invited by then president BJ Habibie to hold a national dialogue to discuss the Papua issue at the Presidential Palace in Jakarta. 

It was no ordinary event. On the contrary, it was an extraordinary gathering of Papua’s leaders prompted by a widespread call for independence in the nation’s easternmost province. 
It was marked by public demonstrations and the raising of the Papuan flag in a several cities. 
All of this met with a harsh response from security forces. All of this occurred in the wake of the euphoria of Indonesia’s transition to democracy.

During the meeting 13 years ago, Team 100 leader Tom Beanal bluntly expressed Papuans’ desire to form an independent state separate from Indonesia. 
This unexpected call shocked Habibie, as well as his Cabinet, who responded by asking Tom to return home and think things over. 
The meeting did not result in anything meaningful. However, it became a milestone for Papuans, who presented their political aspirations with dignity and honor. 
It must be underlined that none of Team 100 were arrested or charged with treason, as is now happening with the president of the so-called Federal Republic of West Papua, Forkorus Yaboisembut, and four of his followers who are being tried for alleged treason and are facing life imprisonment.
Thirteen years on, Papua’s cry for dialogue remains loud. In response, the Yudhoyono administration has held private and formal meetings with Papuan church leaders twice.
 President Susilo Bambang Yudhoyono has also appointed two special representatives, Lt. Gen. (ret.) Bambang Darmono and Dr. Farid Hussain, to address the issue of dialogue through different mechanisms. 
What next in the last two years of Yudhoyono’s presidency? What can we expect as follow up? Will we see political negotiations, as we have seen in Aceh? All these questions remain unanswered.
As we know, dialogue is not the only game in town. Some Papuans do not share this view and have publicly expressed their determination to pursue international legal mediation to bring independence to Papuan. 
However, it remains unclear to the public how this option could be achieved. Others have been advocating for Indonesia to recognize the sovereign state of Papua. 
These advocates have been charged with treason and now are standing trial.
In daily life, we are confronted with other questions that. For instance, what will happen when Papua finally holds its long-delayed gubernatorial election? 
Can the continuing violence in Papua’s highlands and the area near PT Freeport Indonesia’s operations be terminated? 
The violence in those areas have caused a lot of tension, damage and deaths that urgently need to be addressed.
On the government side, we also observe a number of different interpretations on how to conduct a dialogue. 
One approach holds that the dialog should be about Papua and not between Jakarta and Papua, as proposed by many voices in Papua. The logic of this argument is that Papua is part of Indonesia. 
So the polarization of Jakarta and Papua will not help solve the problem. Rather, all stakeholders in Papua should have an equal opportunity to discuss the fate of Papua.
Following the Aceh model, other proponents argue that negotiations should be bipartisan, involving representatives from the Indonesian government and their Papuan counterparts. But this approach still augurs the question of who Papua’s representatives are and whether Papuans can be united. 
Another approach asserts limits on any negotiations on the territorial integrity of Indonesia while preparing to offer a wide range of concessions, including granting amnesty for political prisoners, reviewing the 1969 Act of Free Choice, addressing human rights abuses and reviewing the implementation of special autonomy for Papua. 
The last approach co-opts the whole point of dialogue by creating parallel events to discuss the same issues, albeit infused with completely different notions. 
In the long run this may cause distraction and confusion if negotiations between Jakarta and Papua are realized. 
Obviously, for the government, a Papuan dialogue is not the only game in town either. The Yudhoyono administration confronts many equally pressing issues, such as its energy policy, which has already sparked strong opposition from political opponents.
Meanwhile, unresolved corruption scandals continue to undermine the government’s legitimacy and its capacity to deliver public service.
Nevertheless, if we look back to 1999, Papua’s call for dialogue has not been resolved after 13 years, whereas preliminary engagement between Jakarta and Papua has signaled something positive. 
It is time to take advantage of the goodwill from both sides despite all differences, which are common in any political settings. 
The window of opportunity under the current administration will not be open for much longer and none of us can guarantee whether the next administration will still be willing to engage in dialogue. 
It is also the time for Yudhoyono to conclude his final term by contributing to Indonesia’s democracy and resolving the problem of Papua once for all.

CathNews 1/2/12:Koordinator Jaringan Damai Papua (JDP) Pastor Neles Tebay mendukung desakan Komisi untuk Orang Hilang dan Korban Tindak Kekerasan (KontraS) bahwa persidangan terhadap lima aktivis Papua harus berjalan secara transparan.

“Sidang ini tidak terkait politik. Maka orang dibiarkan mengikuti jalannya persidangan,” kata imam itu kepada ucanews.com belum lama ini.

Namun, ia meragukan tentang pengadilan itu sendiri, karena kemungkinan akan dipersulit kalau dikaitkan dengan politik dan menjadi kendala untuk dialog diantara pemerintah Indonesia dan rakyat Papua.

Menurutnya, dialog merupakan satu-satunya cara untuk menyelesaikan konflik yang sedang berlangsung.

“Dialog akan lebih membantu menyelesaikan konflik,” tegas Rektor Sekolah Tinggi Filsafat dan Teologi Fajar Timur Abepura di Jayapura.

KontraS di Jakarta menekankan pentingnya keadilan dan transparansi terhadap persidangan lima warga Papua yang dituduh makar karena mereka mendeklarasikan Negara Papua Barat.

Kelima orang itu ditangkap bulan Oktober ketika polisi membubarkan Kongres Rakyat Papua III setelah beberapa delegasi mengibarkan bendera Bintang Kejora, simbol dari gerakan kemerdekaan Papua.

Lima orang, yang diadili pekan lalu itu adalah: Forkorus Yaboisembut, yang terpilih sebagai presiden Republik Federal Papua Barat; Eddison G. Waromi, yang terpilih perdana menteri; Agustus Makbrowen Senay, koordinator logistik’; Dominikus Serabut, sekretaris dewan adat Wamena, dan Selphius Bobii, ketua panitia kongres itu.

Mereka dituduh melanggar KUHP Pasal 106 tentang makar. Mereka disidangkan di Pengadilan Negeri di Jayapura, ibukota Provinsi Papua dan divonis 20 tahun penjara.

Komisi mendesak pemerintah Indonesia untuk membiarkan media dan masyarakat internasional untuk meliput sidang itu sebagai bagian dari upaya menyampaikan informasi kepada publik dan komitmen damai menangani masalah-masalah di Papua.

“Kami juga mendesak pemerintah Indonesia untuk menjamin bahwa semua aparat penegak hukum tidak akan dipengaruhi oleh kepentingan politik,” lanjut komisi itu.

WORLD PRESS FREEDOM INDEX: S'PORE RANKED 135 IN WEST PAPUA

World Press Freedom index: S'pore ranked 135
SINGAPORE - The Republic has moved up one place on the 2011-2012 World Press Freedom Index and is now ranked 135, after the last index was released in 2010. The index, compiled by Reporters Without Borders, involved 179 nations.

Malaysia, meanwhile, has moved up 19 places and is now ranked 122 compared to 141 in 2010. It is now ahead of neighbours Brunei, Singapore, Indonesia, Thailand and the Philippines.

"This year's index sees many changes; changes that reflect a year that was incredibly rich in developments, especially in the Arab world," Reporters Without Borders said, adding that the past year also highlighted the role played by Netizens in producing and disseminating news.

It said the international media had paid dearly for its coverage of democratic aspirations or opposition movements as totalitarian and repressive regimes continued to control news and information.

Finland and Norway topped the index again while Eritrea, North Korea and Turkmenistan remained at the bottom of the list.

In the Asia-Pacific region, the report stated that the countries that traditionally performed well did not shine last year.

"With New Zealand's fall to the 13th position, no country in the Asia-Pacific region figured among the top 10 in the index," it said, adding that an army crackdown in West Papua, Indonesia - where at least two journalists were killed, five kidnapped and 18 assaulted last year - was the main reason for the country's fall to the 146th position in the index from 117 in 2010.

The index is calculated through a questionnaire with 43 criteria for assessing the state of press freedom in each country.

Fear For The Safety Of West Papuan Political Prisoners
Dear Mr Rudd,
I am writing to you on behalf of the Australia West Papua Association in Sydney concerning the five West Papuan men who have been charged with treason because of their involvement in the 3rd Papuan People's Congress which was held between the 17 and 19 October 2011.
Shortly after the Congress and as part of a celebration, the Morning Star flag was raised and a declaration of Independence read out. Indonesian security forces accompanied by armoured vehicles immediately moved in to break up the gathering firing live rounds resulting in six people been killed. The security forces also used batons, bamboo poles and the butts of rifles during the arrest of up to 300 delegates resulting in serious injuries. Five people were charged with treason. They are Forkorus Yaboisembet, Edison Gladius Waromi, Agust M. Sananay Kraar, Selpius Bobii, and Dominikus Surabat. The trial against five Papuan activists began on Monday 30 January.
On Saturday the 18 February, the security forces in full riot equipment swept through the Abepura prison where the men are detained. They removed the prisoners belongings including books, letters, plates, glasses and intimidated the prisoners. They also told the prisoners if there was any disturbance at their trial they would be removed from West Papua to stand trial elsewhere.
AWPA is greatly concerned for the safety of these men as many reports have stated that the security forces use torture to intimidate or extract information from prisoners in West Papua. We point out at no time did these men commit violence and they simply expressed peacefully their views on the future of West Papua as is their right under Article 19 of the Universal Declaration of Human Rights.
We urge you to contact the Indonesian President asking that he guarantee the safety of the prisoners and to immediately release all West Papuan political prisoners unconditionally.
A true democracy does not jail people simply because thy expressed a political opinion.

“We don’t want UP4B. We’re not looking for special autonomy, we want a referendum,” said Mako Tabuni, the National Committee spokesman on Monday.

Mako said that freedom for Papua could not be compromised. Special autonomy, as stipulated in Law No. 21/2001, has failed to bring welfare for the Papuans. “Special autonomy has failed, the unit won’t work either. It’s only sugar-coated politics for Papua sent from Jakarta,” Mako went on.

JAKARTA (UMAGI)--  Asing akan tetap melibatkan diri dengan urusan Papua. Itulah yang menjadi perhatian Hariyadi Wirawan ketika diwawancarai itoday, Senin (20/2).


“Asing terlibat karena persoalan Papua tidak pernah selesai,” tutur pengamat hubungan internasional Universitas Indonesia ini.

Menurutnya, apa yang terjadi di Papua sekarang, jelas mengikuti skenario kemerdekaan Kosovo, yang berhasil memerdekakan dirinya dengan bantuan lembaga internasional. Hal ini terlihat dengan didaftarkannya kemerdekaan Papua Barat ke Perserikatan Bangsa-Bangsa (PBB) minggu lalu.
“Jika asing melihat masalah Papua sebagai sebuah isu internasional yang hangat, dan menganggap Indonesia tidak peduli. Maka kesempatan Papua untuk merdeka akan semakin besar,” jelasnya.

Hariyadi mengingatkan, keberadaan AS di Darwin, Australia, walau sebenarnya adalah untuk membendung Cina, tetapi jika masalah Papua semakin memanas, dan memperoleh pengakuan lembaga internasional sebagai sebuah negara merdeka, maka pangkalan AS di Darwin akan menjadi pangkalan yang bersifat multifungsi.
“AS akan mengerahkan pasukannya di Darwin guna melindungi Papua, jika Indonesia nantinya menolak kemerdekaan Papua yang disahkan PBB secara sepihak,” kata Hariyadi.

Apa yang dikatakan Hariyadi mengenai ancaman pangkalan AS di Darwin memang tidak bisa dianggap enteng. Sebab posisi Darwin sangat untuk mendukung posisi AS di ASEAN dan Laut Cina Selatan, atas Cina dan Rusia.
Tidak hanya itu, posisi Darwin juga memudahkan AS untuk mengirimkan pasukannya dengan menggunakan kapal selam dan kapal induk, ke berbagai belahan dunia, khususnya Asia Pasifik.

Bagi Hariyadi, alasan mengapa masalah Papua tidak pernah selesai, karena pemerintah selalu menggunakan cara represif dengan menggunakan kekuatan bersenjata. Sedangkan cara pendekatan lainnya kurang maksimal, sebab tim yang dibentuk selalu saja tidak bekerja dengan semestinya.*

Dear friends,
The Asian Human Rights Commission (AHRC) has received information regarding the condition of Kimanus Wenda, a political prisoner at Nabire prison, Papua, who has a tumor in his stomach and must be operated on. Although Indonesian law clearly notes that it is the state’s obligation to provide medical fees, the Papua legal and human rights department is refusing to pay for Mr. Wenda's surgery due to a lack of funds. Moreover, the goverment is now claiming that Mr. Wenda does not require surgery, although local activists found the opposite to be true.
CASE NARRATIVE:
According to the information received from KontraS, ALDP and SKPHP, on April 4, 2003, at around 1am, there was a burglary at 1702/ Jayawijaya Wamena military district staff headquarters armory.
Eight perpetrators were arrested in connection to this theft: Yafrai Murib, Numbungga Telenggen, Enos Lokobal, Linus Hiluka, Kanius Murib, Kimanus Wenda, Des Wenda and Mikael Haselo. On January 15, 2004, according to the verdict declared by the Wamena district court, all the victims were found guilty for rebellion under articles 106 and 110 of the Criminal Code. Yafrai Murib and Numbungga Telenggen were sentenced to lifetime imprisonment, while the others were sentenced to 20 years imprisonment. Civil society considers this verdict to not be based on legal facts.
Since 2010, Mr. Wenda has had a tumor in his stomach and is constantly vomiting. He informed the health staff at Nabire prison but was not given any adequate response. On February 2, 2011, the Nabire hospital issued a reference letter regarding Mr. Wenda's sickness and the need for him to be operated at Jayapura hospital. Two days later, Mr. Wenda’s legal counsel sent a medical leave letter to the head of Papua’s regional office of law and human rights and the head of Nabire prison, but received no response. On September 19, SKPHP met the head of Papua legal and human rights department but the department said it has no money and thus cannot pay for Mr. Wenda's operation. This violates Indonesian law under Indonesian Government Regulation No. 32/1999 on Terms and Procedures on the Implementation of Prisoners’ Rights in Prisons, which states that it is a state obligation to provide medical fees and treatment. While civil society is now gathering funds to pay for the operation in Jayapura hospital, it is not yet enough.
Furthermore, on December 16, at the hearings between KontraS and the ministry of law and human rights, the staff of Nabire prison said that based on their report and the statement of the prison chief, Mr. Wenda was seen playing volley ball in prison and therefore his stomach tumour is not dangerous and does not need to be operated in Jayapura hospital. However, on December 21, when local activists brought Mr. Wenda to be examined at Nabire hospital, John, the surgery doctor who examined Mr. Wenda, stated that the tumour is severe and should be operated as soon as possible. The government denial to treat Mr. Wenda has resulted in much civil society concern about his safety.
ADDITIONAL INFORMATION:
The AHRC has recorded that political prisoners, especially in Papua, face ill-treatment and torture in prison, as in the case of Fendinand Pakage, who was tortured by a Abepura prison officer in 2008, resulting in permanent damage to his right eye, and in the case of Buchtar Tabuni in 2009, also beaten and tortured by a Abepura prison officer. Political prisoners’ rights are bare fulfilled, especially the right to health, as seen by Filep Karma, who was neglected at Dok II Jayapura hospital although his ureter should be operated.
Furthermore, on August 28, 2007, Mikael Haselo, a political prisoner arrested and charged in the same case as Mr. Wenda, died after being treated at Bayangkara hospital, Makasar, South Sulawesi, due to the complication of some diseases, such as cough, enteritis, bronchitis and lung inflammation.

Please write letters to the authorities listed below asking them to intervene in this case immediately.
Please be informed that the AHRC is also sending letters to the Special Rapporteur on the rights of indigenous people, and the Working Group on arbitrary detention, calling for their intervention into this matter.

I am writing to voice my deep concern regarding the condition of Kimanus Wenda, a political prisoner at Nabire prison.
According to the information received from the Asian Human Rights Commission, on 4 April 2003, at around 1am local time, there was a burglary at 1702/ Jayawijaya Wamena military district staff headquarters armory and eight perpetrators were arrested, namely Yafrai Murib, Numbungga Telenggen, Enos Lokobal, Linus Hiluka, Kanius Murib, Kimanus Wenda, Des Wenda and Mikael Haselo.
I also know that on 15 January 2004, according to the verdict declared by the Wamena district court, all the victims were found guilty for rebellion under articles 106 and 110 of the Criminal Code. Yafrai Murib and Numbungga Telenggen were sentenced to lifetime imprisonment, while the others were sentenced to 20 years imprisonment. Civil society considers this verdict to not be based on legal facts.
I learnt that since 2010, Mr. Wenda has had a tumor in his stomach and is constantly vomiting. He called the health staff at Nabire prison, but received no serious response. On February 2, 2011, the Nabire hospital issued a reference letter regarding Mr. Wenda's sickness and the need for him to be operated at Jayapura hospital. Two days later, Mr. Wenda’s legal counsel sent a medical leave letter to the head of Papua’s regional office of law and human rights and the head of Nabire prison, but received no response. On September 19, SKPHP met the head of Papua legal and human rights department but the department said it has no money and thus cannot pay for Mr. Wenda's operation. I am aware that this violates Indonesian law under Indonesian Government Regulation No. 32/1999 on Terms and Procedures on the Implementation of Prisoners’ Rights in Prisons, which states that it is a state obligation to provide medical fees and treatment. While civil society is now gathering funds to pay for the operation in Jayapura hospital, it is not yet enough.
I wish to point out that on December 16, at the hearings between KontraS and the ministry of law and human rights, the staff of Nabire prison said that based on their report and the statement of the prison chief, Mr. Wenda was seen playing volley ball in prison and therefore his stomach tumour is not dangerous and does not need to be operated in Jayapura hospital. However, on December 21, when local activists brought Mr. Wenda to be examined at Nabire hospital, John, the surgery doctor who examined Mr. Wenda, stated that the tumour is severe and should be operated as soon as possible. The government denial to treat Mr. Wenda has resulted in much civil society concern about his safety.
Based on the information stated above, I urge you to promptly pay the medical fees necessary for Mr. Wenda’s proper treatment, in accordance with government obligations to do so. I also urge you to look into all the allegations in this case and to take appropriate action against those found responsible, and prevent any future recurrence.
